Private Schools, Quality Education, Fee Regulation & Teacher Service Protection Policy

1. Vision and Objective

Sanvidhan Loktantra Party believes that education is one of the most important foundations of a constitutional democracy and that every child must have access to quality, safe, transparent and affordable education.

At the same time, teachers are the foundation of the education system. A teacher who provides continuous and responsible service must receive fair wages, timely payment and reasonable service protection.

Our policy will therefore establish a balanced framework that:

  • protects the interests of students;
  • protects parents from unreasonable financial burdens;
  • protects qualified teachers from arbitrary denial of salary or service;
  • ensures proper maintenance and safety of schools;
  • regulates unreasonable and non-transparent fees;
  • prohibits donation and capitation-fee practices;
  • makes the admission process transparent; and
  • allows private educational institutions to function and develop within a clear regulatory framework.

2. Proper Maintenance and Standards of Private Schools

Every private school must comply with prescribed government standards relating to:

  • structural safety of the school building;
  • fire and emergency safety;
  • sanitation and cleanliness;
  • drinking water;
  • toilets and hygiene;
  • classrooms and ventilation;
  • laboratories;
  • libraries;
  • sports and recreational facilities;
  • teaching and learning resources;
  • student safety and security; and
  • other facilities prescribed by the competent authority.

Regular inspections and appropriate compliance mechanisms will be established.

Where serious deficiencies affecting the health, safety or education of students are found, the management will be required to rectify them within a prescribed period.


3. Appointment of Qualified Teachers

Every private school shall appoint teachers possessing the educational, professional and statutory qualifications prescribed by the competent government authorities.

Depending upon the nature of the post and subject, the applicable qualifications may include B.Ed., D.Ed., M.Ed. or other recognised qualifications.

No institution should compromise the quality of education by appointing persons who do not satisfy the prescribed qualification requirements.

Recruitment should be conducted through a transparent process, with proper appointment orders, service records and salary records.


4. Service Protection for Teachers Already in Employment

Sanvidhan Loktantra Party proposes a special transitional service-protection framework for teachers who were already working in private schools as on 15 August 2026.

A teacher who:

  1. was actually working as a teacher in a recognised private school on 15 August 2026;
  2. has completed at least one year of service in that institution; and
  3. satisfies the applicable government-prescribed qualification requirements,

shall receive statutory protection regarding timely payment of salary and continuity of service, subject to the applicable service rules and law.

Such a teacher should not be deprived of salary merely because the management claims financial difficulty, particularly where the institution continues to collect student fees and operate the school.

Any termination, reduction of salary or discontinuation of service must be based on lawful and transparent grounds and follow due process.


5. Timely Payment of Teachers’ Salaries

The primary responsibility for payment of salaries to teachers and non-teaching employees shall remain with the school management.

Salary must be paid:

  • regularly;
  • within the prescribed period;
  • through a transparent banking system; and
  • in accordance with applicable government and employment regulations.

A school should not collect fees from students and parents while deliberately withholding salaries payable to teachers and employees.

Where a school claims that it is genuinely unable to meet its salary obligations, its financial position may be subjected to an appropriate government-authorised review.


6. Protection of Students Where a School Becomes Financially Unviable

The education of students must not stop because of a dispute or financial difficulty of a private educational institution.

If an authorised financial and administrative assessment establishes that a private school is genuinely unable to continue functioning while meeting prescribed educational, safety and salary standards, the government should have a statutory mechanism to:

  • facilitate restructuring or supervised management;
  • protect the education of existing students;
  • ensure payment of lawful employee dues;
  • provide an orderly transition to another recognised institution; or
  • where legally and administratively appropriate, take over or transfer the institution to the competent government authority.

Any such action must follow due process and applicable law.

The objective shall be continuity of education, not disruption of students’ academic careers.


7. Transparent Regulation of School Fees

Private schools should have the ability to recover reasonable costs and maintain educational standards, but parents must not be subjected to arbitrary or unexplained charges.

A transparent fee-regulation framework shall be established.

While determining permissible fees, the competent authority may consider genuine and documented expenditure such as:

  • salaries of teachers;
  • salaries of non-teaching staff;
  • electricity and water;
  • building maintenance;
  • educational materials;
  • laboratory expenses;
  • library facilities;
  • sports facilities;
  • technology and educational infrastructure;
  • reasonable administrative expenses;
  • statutory obligations; and
  • other expenditure permitted under applicable law.

The school shall disclose its approved fee structure clearly to parents.

No unauthorised or hidden charges should be imposed.


8. Zero Donation and Capitation Fee Policy

Sanvidhan Loktantra Party proposes a strict Zero Donation / Zero Capitation Fee principle for school admissions.

No student or parent should be required to pay money merely for obtaining admission.

Admission must not depend upon:

  • donation;
  • capitation fee;
  • unofficial payment;
  • cash payment outside the approved fee structure; or
  • any other disguised admission charge.

Any permissible development-related contribution must be specifically authorised, transparently accounted for and used only for the permitted purpose.


9. Development Fund – Maximum 10%

To enable private schools to improve their infrastructure and educational facilities, the policy proposes that a Development Fund of up to a maximum of 10% of the approved education fee may be permitted, subject to the applicable legal framework.

The Development Fund shall be:

  • separately identified;
  • transparently accounted for;
  • used only for approved development purposes;
  • supported by proper records; and
  • disclosed through an annual financial statement.

The fund should be used for genuine improvements such as:

  • classrooms;
  • laboratories;
  • library facilities;
  • sports facilities;
  • digital education infrastructure;
  • safety systems;
  • sanitation;
  • school equipment; and
  • other approved educational infrastructure.

It must not become a disguised donation or capitation fee.


10. Transparent Admission System

Admission to private schools should be based on clear, objective and publicly declared criteria.

The admission process should be conducted through a transparent system wherever practicable, including:

  • online application;
  • publication of eligibility criteria;
  • publication of available seats;
  • computerised allocation or lottery where applicable;
  • publication of selection lists;
  • disclosure of applicable reservation requirements; and
  • a mechanism for parents to raise grievances.

Parents should be able to understand why a student was selected or not selected under the applicable admission criteria.


11. Opportunity for Local Students

Sanvidhan Loktantra Party proposes a framework under which 50% of available admissions may be earmarked for eligible students from the local area, subject to the Constitution, applicable reservation provisions and existing statutory requirements.

The remaining 50% may be made available to eligible students from outside the defined local area.

The definition of “local area” shall be determined through objective geographical and residential criteria prescribed by the competent government authority.

This proposal is intended to ensure that schools established within a locality also provide meaningful educational opportunities to children residing in that locality.


12. Merit, Reservation and Legal Compliance

The proposed local-area admission framework shall not operate independently of constitutional and statutory requirements.

Admission shall continue to comply with:

  • applicable reservation policies;
  • statutory rights;
  • prescribed eligibility requirements;
  • recognised admission procedures;
  • merit requirements wherever applicable; and
  • judicial and constitutional requirements.

The objective is to create a transparent system in which local opportunity, merit and legal rights are appropriately accommodated.


13. Annual Transparency Report

Every recognised private school should maintain and, subject to applicable privacy laws, disclose an annual education and financial transparency statement containing information such as:

  • number of students;
  • number of teachers;
  • teacher qualifications;
  • approved fee structure;
  • Development Fund collected;
  • utilisation of Development Fund;
  • major infrastructure expenditure;
  • teacher salary compliance;
  • scholarships or statutory benefits;
  • available seats; and
  • other information prescribed by the competent authority.

This will increase accountability without unnecessarily interfering with the legitimate administration of private educational institutions.


14. Protection of Parents

Parents shall have access to a simple grievance mechanism against:

  • unauthorised fees;
  • donation or capitation demands;
  • hidden charges;
  • refusal to issue receipts;
  • arbitrary admission practices;
  • non-transparent fee increases;
  • denial of statutory rights; and
  • other violations of prescribed educational regulations.

Complaints should be disposed of within a time-bound mechanism.


15. Accountability of School Management

School managements will retain the right to manage their institutions in accordance with law.

However, management autonomy must operate together with accountability towards:

  • students;
  • parents;
  • teachers;
  • employees; and
  • the education system.

Where violations are established, proportionate statutory action should be taken after giving the concerned institution an opportunity to comply or present its case, wherever required by law.


16. Government Responsibility

The government shall establish a single-window, transparent and time-bound regulatory mechanism for private schools.

The system should reduce unnecessary administrative burden while ensuring effective monitoring of:

  • school standards;
  • teacher qualifications;
  • salary compliance;
  • fee regulation;
  • admission transparency;
  • student safety;
  • infrastructure;
  • financial transparency; and
  • grievances.

The purpose of regulation should be accountability and quality—not unnecessary interference.


17. Core Principle of Sanvidhan Loktantra Party

Sanvidhan Loktantra Party believes that private educational institutions have an important role in India’s education system. They should be allowed to function, innovate and develop, but education cannot become an unregulated financial burden on families.

At the same time, teachers cannot be treated merely as temporary employees when they have provided continuous and qualified educational service.
